Art. 1 GENERAL MANDATORY INFORMATION TO THE BUYER
The seller, pursuant to and for the purposes of art. 7 of Legislative Decree April 9, 2003, no. 70, informs the buyer that the goods/services covered by this contract are provided by Avio Edizioni Scientifiche Srl, with registered office in Rome, VAT and Tax Code: 15202361000, R.E.A. no.: RM - 1574628

Avio Edizioni Scientifiche Srl offers on its website product sales services, hereinafter referred to as “the avioedizioniscientifiche.it services”.
Users, both registered and unregistered, who wish to use the services available on the site, accept the general conditions set out in this document.
Avio Edizioni Scientifiche Srl is not responsible for the improper use that may be made of the contents of its web pages, as it is the sole responsibility of those who access and use them; such improper use includes the following behaviors:
1. Reproduce or copy, distribute, allow public access through any means of publication, transform or modify the contents, unless you have the authorization of the holder of the relevant rights or the action is legally permitted.
2. Remove, circumvent or manipulate the "copyright" and other significant information about the rights of the holders incorporated in the pages of www.avioedizioniscientifiche.it, as well as technical protection devices, or any information mechanism that may be contained in the pages of www.avioedizioniscientifiche.it.

Art. 2 CONCLUSION OF THE CONTRACT
To make purchases, it is necessary to register and/or directly fill out the appropriate form on the purchase page of the website www.avioedizioniscientifiche.it.
Each customer declares that they have full authority to use credit cards or other payment instruments usable on www.avioedizioniscientifiche.it and that they have sufficient credit to cover all costs related to the purchase of products through www.avioedizioniscientifiche.it.
By selecting the "Pay" button during the purchase process, the buyer declares to fully and unconditionally accept all of these General Terms and Conditions of Sale.
The data recorded by www.avioedizioniscientifiche.it constitute proof of the transactions carried out on www.avioedizioniscientifiche.it.
www.avioedizioniscientifiche.it will confirm their orders by sending an e-mail.
The prices of the goods/services provided, any taxes and duties, as well as additional costs for shipping and packaging, are indicated precisely during the order definition, before its confirmation and before payment.
Www.avioedizioniscientifiche.it reserves the right to change its prices at any time, but products will be invoiced based on the rates in effect at the time the orders are stored (upon reservation of product availability).
The products remain the property of the supplier until the full payment of the amount due.
Www.avioedizioniscientifiche.it reserves the right to refuse an order from any customer with whom there is an ongoing dispute.
1. The goods are sold and purchased in accordance with an order from the buyer sent by the latter and accepted by the seller according to the procedures set out in the following point 2. The order is subject to these conditions which govern the contract in such a way as to exclude any other condition and procedure by which an order may be made by the buyer.
2. Once the products are displayed on the purchase page, you can choose the one you are interested in by clicking on the desired product. This will display a summary page containing a more detailed description sheet, and by selecting the "Add to cart" button, you will be able to reserve the desired product.
On the next screen, the user will be able to check the types of products they wish to purchase and the related prices, and at this point it will be possible to confirm, cancel, or modify the order.
3. The seller, pursuant to art. 13 of the aforementioned Legislative Decree no. 70 of 2003, having verified the availability of the chosen product, issues acceptance of the buyer's order without undue delay and by e-mail containing a summary of the general and specific conditions applicable to the contract, information relating to the essential characteristics of the good or service, and a detailed indication of the price, means of payment, withdrawal, delivery costs, and applicable taxes.
Once the purchase order has been confirmed, the buyer has the possibility to check its details at any time on the relevant web page.
Art. 3 PRICES AND RATES
The prices of the goods/services provided, any taxes and duties, as well as additional costs for shipping and packaging are indicated precisely during the order process, before its confirmation.
Art. 4 PRODUCT DESCRIPTIONS
The descriptions of the products offered by www.avioedizioniscientifiche.it are prepared using the information provided to Avio Edizioni Scientifiche Srl by the suppliers. Furthermore, the information provided for each product, as well as its photographs and videos, are published on www.avioedizioniscientifiche.it for guidance purposes only, as are all trade names, trademarks, or distinctive symbols of any kind contained on the pages of the site www.avioedizioniscientifiche.it.
Www.avioedizioniscientifiche.it undertakes to make every effort to correct as soon as possible any errors and omissions that may occur in the product descriptions.
Finally, products with particular environmental and social sustainability characteristics, recycled, from local supply chains or fair trade circuits are duly described. Where the aforementioned description is not present, the product does not have the previous requirements.
Art. 5 PAYMENT OF THE PRICE
Payment for purchases can be made via PayPal, credit card, or prepaid card. Accepted cards include all those belonging to the Visa, Visa Electron, and MasterCard circuits, including PostePay and PostePay Gift cards.
For greater security, only the banking partner has access to the card data used for payment, while www.avioedizioniscientifiche.it has no way of knowing or storing such data. The purchase price will be charged to the buyer's bank account within 4 days from the date of the order and will be effective after authorization is confirmed by the banking service center.
In the event that the virtual POS (Internet point of sale terminal) communicates the refusal of the card, the order will be automatically cancelled, informing the buyer online of the aforementioned cancellation. In case of unavailability of the product after the order has already been placed, the buyer will be informed by e-mail of its cancellation.
Art. 6 RIGHT OF WITHDRAWAL
1. The buyer has the right to withdraw from the contract entered into under these general conditions, without any penalty and without specifying the reason, within 14 days from the day the goods are received by the buyer, pursuant to Articles 64 et seq. of the Consumer Code (Legislative Decree 22.07.2005 no. 206). The right of withdrawal is exercised by sending, within the prescribed period, a communication to the address indicated in Article 1 by registered letter (preferably anticipated by email) with acknowledgment of receipt. The communication may also be sent, within the same period, by telegram to the addresses and numbers indicated in Article 1.
Www.avioedizioniscientifiche.it will reply by e-mail providing detailed instructions for the return.
2. If the delivery of the goods has taken place, the buyer who has sent the withdrawal is required to return the goods by shipping them within a period not exceeding three (3) working days from the date of receipt.
The costs and risks related to the return of the products will be borne by the buyer, who must send them securely with the necessary guarantees so that the products arrive in perfect condition. The only expenses owed by the buyer for exercising the right of withdrawal under this article are the shipping costs for returning the goods to the seller. In the event of payment made before exercising the right of withdrawal, the seller is required to refund the amount paid within thirty days from the date on which they became aware of the exercise of the withdrawal.
3. Returns cannot be made under any circumstances if the supplied products have been used. The products must be returned with appropriate protection, in their original packaging, in perfect condition (not damaged or soiled), with all accessories, instructions and documentation, with any identification tag and/or labels still attached, clean and not wrinkled.
Returns of packages that do not display any element allowing the identification of the sender (order number, name, address) will not be accepted either.
Art. 7 WARRANTY OF CONFORMITY OF GOODS
1. The seller is liable to the buyer for any lack of conformity of the purchased goods pursuant to and for the purposes of the Consumer Code (Title III - Legal guarantee of conformity and commercial guarantees for consumer goods, CHAPTER I Sale of consumer goods, articles 128 et seq. of Legislative Decree 22.07.2005 no. 206), provided that it exists at the time of delivery of the goods and manifests itself within two days from the receipt of the goods and provided that it is not a defect known to the buyer at the time of the conclusion of the purchase contract.
2. Any defect must be communicated to the seller within two days of receipt of the goods, by sending a registered letter with return receipt (anticipated by email) to the address referred to in art. 1.
The date of the postmark on the registered letter will be considered binding between the parties.
Art. 8 PROTECTION OF PERSONAL DATA
The seller informs the buyer, pursuant to art. 13 of Legislative Decree 30 June 2003, no. 196 (Consolidated Privacy Act) containing provisions for the protection of individuals and other subjects with regard to the processing of personal data, that the personal data provided by the buyer or otherwise acquired in the course of the seller's activity may be subject to processing, in compliance with the aforementioned legislation and Legislative Decree no. 171/98 regarding privacy in telecommunications. The personal data will be processed by the seller electronically in the strictest confidence and will be used solely for the execution of the contract and for the management of the product purchase order.
The provision of personal data is mandatory for the supply of goods and failure to provide them will prevent the conclusion and execution of the contract.
The data controller is: Avio Edizioni Scientifiche Srl. No data processing other than that necessary for the execution of the supply may be carried out without the express consent of the buyer. Pursuant to art. 7 of Legislative Decree 196/03, the buyer has the right to obtain information on the origin of personal data, the purposes and methods of processing, the logic applied in case of processing carried out with the aid of electronic instruments, the identification details of the controller, the processors and the representative designated pursuant to article 5, paragraph 2, of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as designated representative in the territory of the State, as processors or persons in charge.
The buyer also has the right to obtain the updating, rectification or, when interested, integration of the data, the deletion, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed, and certification that the above operations have been brought to the attention, including as regards their content, of those to whom the data have been communicated or disseminated, except in cases where such fulfillment proves impossible or involves the use of means manifestly disproportionate to the right protected.
Finally, the buyer has the right to object, in whole or in part, for legitimate reasons, to the processing of personal data concerning him or her, even if pertinent to the purpose of collection, to the processing of personal data concerning him or her for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication. To exercise the rights provided for by art. 7 of Legislative Decree 196/03, the buyer may submit his or her written request, by registered letter with return receipt, or by email, to the data controllers, sending the request to the addresses referred to in art. 1.
Art. 9 INTELLECTUAL PROPERTY
Avio Edizioni Scientifiche Srl reserves all rights to the texts, works, illustrations and images reproduced on the web pages of the site www.avioedizioniscientifiche.it in accordance with copyright as well as in accordance with Intellectual Property.
In this regard and in accordance with the provisions of the intellectual property law, use is authorized only for private use unless otherwise provided, including further restrictions of the Intellectual Property Code.
Any other use constitutes forgery and is sanctioned in accordance with Intellectual Property law, except with prior written authorization from Avio Edizioni Scientifiche Srl. All total or partial reproductions of the Avio Edizioni Scientifiche catalog are strictly prohibited.
Art. 10 LIABILITY AND DISPUTE RESOLUTION
The photographs and texts reproduced to illustrate the products offered are not contractual. Consequently, Avio Edizioni Scientifiche Srl will not be held responsible in case of errors in any advertising of the products for sale that may have been received from the respective suppliers.
Avio Edizioni Scientifiche Srl is not responsible for damages, whether material, immaterial, or bodily, that may result from a malfunction or improper use of the marketed products. The same applies to modifications to the products that may have been made by suppliers.
The liability of Avio Edizioni Scientifiche Srl, in any case, will be limited to the amount of the order and cannot be claimed for simple errors or omissions that may have existed despite all precautions taken in the presentation of the products.
Avio Edizioni Scientifiche Srl shall not be liable to a buyer or to any third party for any indirect damages, loss, profit, or business volume occurring in any way, even if they were reasonably foreseeable by Avio Edizioni Scientifiche Srl.
Without limiting the foregoing clauses, the liability of Avio Edizioni Scientifiche Srl under these general conditions cannot exceed an amount equal to the sums paid or to be paid for the transaction giving rise to said liability, whatever the cause or form of the action in question.
Avio Edizioni Scientifiche Srl cannot be held responsible for breach of contract in the event of stock shortages or product unavailability, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communication, flood or fire.
In case of dispute, the buyer is required to contact and will contact Avio Edizioni Scientifiche Srl (using the various available methods) to obtain an amicable solution.
For all civil disputes concerning this contract or connected to it, which may arise between the parties, the exclusive territorial jurisdiction is that of the judge of the place of residence or domicile of the buyer, if located within the territory of the State, as established by art. 63 of Legislative Decree No. 206 of September 6, 2005 "Consumer Code", regarding the competent court.
Art. 11 CHANGES TO THESE GENERAL CONDITIONS
Avio Edizioni Scientifiche Srl reserves the right to modify these general terms and conditions of sale without notice, being able to change, remove or add both the contents and services provided through the site and the format in which they appear or are represented on its servers.
These changes will be in effect from the moment of their publication on the website ww.avioedizioniscientifiche.it and must be accepted by the buyer each time they make a purchase through the site www.avioedizioniscientifiche.it.
In the event that any of the terms of the general conditions are illegal or unenforceable, it shall be null and void by law and the agreements between the parties shall apply and, in their absence, the provisions of the Civil Code shall apply.
Art. 12 EXHAUSTIVENESS
The purchase does not entail for the buyer any charges, obligations, or expenses other than those established in the contract.
N.B.:
1. These Conditions may be printed or saved on a durable medium, in compliance with the provisions of Art. 12 of Legislative Decree 70/2003 and Art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
2. The sales contract referred to in these Conditions and its execution are governed by Italian law, with the exclusion of conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods.
